RAFALE RENT L.L.C. — TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”, or “your”) and Rafale Car Rental L.L.C., a limited liability company duly incorporated in the Emirate of Dubai, United Arab Emirates, holding Trade Licence No. 1567586, Commercial Registration No. 2736956, and Tax Registration No. 105209212700001, with its registered address at Office No. 5, I- SH-371, Dubai Industrial City, Saih Shuaib 2, Dubai, United Arab Emirates (“Rafale”, “we”, “us”, or “our”).
By accessing, registering on, or using Rafale’s website, mobile application, or any service operated by Rafale (the “Platform”), you acknowledge that you have read, understood, and agreed to be bound by these Terms and all applicable laws and regulations of the United Arab Emirates relating to vehicle rental services, vehicle subscriptions, and lease-to-own agreements.
1. Definitions
Account
The online profile created by the Customer to access Rafale’s services.
Platform
The website, mobile application, or any digital platform operated by Rafale.
Rafale
Rafale Car Rental L.L.C., provider of the services described under these Terms.
Vehicle
The motor vehicle provided to the Customer, including keys, documents, accessories, electronic systems, and GPS devices.
Subscription
Any vehicle rental agreement offered by Rafale, including fixed-term subscriptions and Lease To Own agreements.
Subscription Price
The amount applicable to the Customer’s agreement.
12-Month Subscription
A fixed-term vehicle rental agreement for twelve (12) months.
24-Month Subscription
A fixed-term vehicle rental agreement for twenty-four (24) months.
Lease To Own
A contractual arrangement allowing the Customer to rent a vehicle with the possibility of acquiring ownership at the end of the agreement, subject to full payment of all amounts due and exercise of the purchase option.
Salik
Dubai’s electronic road toll system.
Additional Fees
Any amounts relating to fines, tolls, late payments, damages, repairs, administrative fees, legal fees, or contractual breaches.
Emirates ID
The official United Arab Emirates national identity card.
PDPL
Federal Decree-Law No. 45 of 2021 regarding Personal Data Protection.
PAI
Personal Accident Insurance covering bodily injury, medical expenses, disability, or death of the driver or passengers. PAI is not included unless expressly stated otherwise.
2. Eligibility
To use Rafale’s services, the Customer must:
a) be at least twenty-three (23) years old;
b) hold a valid driving licence recognised in the United Arab Emirates;
c) provide a valid Emirates ID;
d) provide accurate, complete, and up-to-date information.
Rafale reserves the right to refuse any application without justification.
3. Contract Formation
Any reservation, electronic signature, WhatsApp confirmation, email confirmation, payment, or digital approval constitutes full acceptance of these Terms and Conditions.
The agreement becomes effective once the Vehicle is delivered or made available to the Customer.
4. Vehicles and Availability
Photographs, videos, visuals, and promotional materials are provided for illustrative purposes only and do not constitute a contractual commitment.
The delivered Vehicle may present minor aesthetic differences due to:
• availability;
• configuration;
• normal wear and tear;
• operational constraints.
Such differences shall not entitle the Customer to cancellation, refund, compensation, or price reduction.
Rafale does not guarantee a specific model, colour, or configuration.
In case of unavailability, Rafale may provide an equivalent or superior vehicle without compensation.
5. Types of Agreements
5.1 12-Month Subscription
The Customer commits to a fixed term of twelve (12) months.
Any early termination shall result in a penalty equal to fifty percent (50%) of the remaining contract value.
5.2 24-Month Subscription
The Customer commits to a fixed term of twenty-four (24) months.
Any early termination shall result in a penalty equal to fifty percent (50%) of the remaining contract value.
5.3 Lease To Own
5.3.1
Rafale may offer certain vehicles under a Lease To Own arrangement.
5.3.2
The Vehicle remains the exclusive property of Rafale or its financing partner throughout the duration of the agreement.
5.3.3
Ownership transfer shall occur only after:
a) full payment of all instalments;
b) full settlement of all fines, damages, penalties, and administrative fees;c) written exercise of the purchase option by the Customer;
d) execution of all ownership transfer documents.
5.3.4
Any payment delay exceeding three (3) days authorises Rafale to:
• immediately immobilise the Vehicle;
• repossess the Vehicle without judicial notice;
• suspend the agreement immediately;
• initiate any recovery procedure deemed necessary.
5.3.5
In case of early termination:
• all amounts previously paid remain fully retained by Rafale;
• the Customer loses any right to acquire ownership of the Vehicle;
• additional early termination fees may apply.
5.3.6
The Customer shall have no ownership rights over the Vehicle before official title transfer.
6. Payments and Deposits
6.1
All payments shall be made in UAE Dirhams (AED).
6.2
Payments are due in advance in accordance with the signed agreement.
6.3
The Customer expressly authorises Rafale to perform automatic direct debits (“Direct Debit”) on the registered payment method for:
• instalments;
• fines;
• Salik charges;
• administrative fees;
• repairs;
• damages;
• penalties;
• legal fees;
• or any other amount due under the agreement.
6.4
Rafale collects payments in its own name and/or on behalf of its commercial partners and vehicle suppliers.
6.5
Payments shall be made exclusively through Direct Debit using the payment method approved by the Customer upon execution or activation of the agreement.
6.6
A late payment fee of one hundred dirhams (AED 100) per day applies to overdue amounts.
6.7
In the event of payment default exceeding three (3) days:
• Rafale may immediately immobilise or repossess the Vehicle;
• the agreement may be suspended or terminated without notice;
• late payment charges shall continue to accrue;
• Rafale may initiate legal or recovery proceedings.
6.8
Rafale may require a security deposit depending on the Vehicle, Customer profile, or applicable agreement.
6.9 Salik Administrative Fees
For all Salik-related charges, Rafale shall apply administrative fees equal to twelve percent (12%) excluding VAT of the total Salik charges billed to the Customer.
These administrative fees are automatically added to the amount due and are non-refundable.
6.10 Recovery and Legal Costs
The Customer shall bear all:
• recovery costs;
• legal fees;
• court fees;
• administrative expenses;
• banking fees;
• vehicle recovery and investigation costs.
7. Customer Responsibilities
The Customer must:
a) operate the Vehicle lawfully and safely;
b) ensure that only authorised drivers use the Vehicle;
c) immediately report any accident, theft, or damage;
d) return the Vehicle in the same condition, fair wear and tear excepted.
8. Usage Restrictions
The Customer shall not:
a) drive outside the United Arab Emirates;
b) drive on desert, sand, beach, or unpaved roads;
c) participate in racing, drifting, or track activities;
d) smoke inside the Vehicle;
e) vape inside the Vehicle;
f) transport pets;
g) use the Vehicle for deliveries or unauthorised commercial activities;
h) drive under the influence of alcohol or drugs;
i) tamper with GPS systems, electronic systems, or mileage.
Any violation may result in immediate termination of the agreement and repossession of the Vehicle.
9. Maintenance and Servicing
Rafale shall perform scheduled maintenance at authorised service centres.
The Customer must present the Vehicle whenever requested for servicing.
Any mechanical damage resulting from:
• misuse;
• aggressive driving;
• incorrect fuel;
• overloading;
• track use;
• negligence;
shall be fully charged to the Customer.
Rafale may provide a replacement vehicle subject to availability, without guarantee of identical category.
10. Accidents, Damage, and Theft
In case of accident:
a) a police report must be obtained within twenty-four (24) hours;
b) Rafale must be informed immediately;
c) only repairs authorised by Rafale are permitted.
If no valid police report is provided, the Customer shall bear full responsibility for:• repair costs;
• immobilisation costs;
• loss of use;
• indirect damages suffered by Rafale.
In case of theft, a police report must be filed within two (2) business days.
11. Insurance
Vehicles are insured in accordance with applicable UAE laws.
However, the Customer remains responsible for:
• insurance excess/deductibles;
• exclusions;
• uninsured damages;
• immobilisation costs;
• loss of use;
• damages caused by negligence or prohibited use.
Insurance does not cover:
• off-road driving;
• driving under influence;
• unauthorised drivers;
• tyre or wheel damage;
• lost keys;
• absence of police report;
• intentional or grossly negligent damage.
PAI is not included unless expressly stated otherwise.
12. Fines, Salik, and Administrative Charges
The Customer is responsible for:
• all traffic fines;
• Salik charges;
• violations;
• government fees;
• recovery-related costs.
Rafale may automatically settle such amounts and recharge:
a) the exact amount paid;
b) a fixed administrative fee of thirty dirhams (AED 30) per fine;
c) any additional administrative or processing costs.
13. Schedule of Penalties
Violation and Penalty
Desert / off-road driving = AED 10,000 + damages
Racing / drifting / track use = AED 10,000 + damages
Dangerous misuse = AED 20,000 + repair costs
Vaping inside Vehicle = AED 1,000
Pets inside Vehicle = AED 1,000
Late return = AED 2,000 per day
Lost key = Actual replacement cost
Lost EV charging card = Minimum AED 1,000 or more depending on vehicle model
Missing fuel = Fuel cost + AED 50
Contractual non-payment = AED 5,000
All amounts are subject to applicable VAT.
14. Personal Data and GPS
Rafale processes personal data in accordance with the PDPL.
Vehicles may be equipped with:
• GPS systems;
• geolocation systems;
• telematics;
• remote immobilisation systems.
The Customer expressly accepts such monitoring during the entire agreement period.
Data may be used for:
• security;
• fraud prevention;
• vehicle recovery;
• mileage monitoring;
• contractual enforcement.
15. Image Rights
The Customer authorises Rafale to use photographs, videos, or visual content of the Vehicle for promotional, marketing, or commercial purposes, provided that no sensitive personal data is disclosed.
16. Vehicle Immobilisation and Repossession
Rafale may immediately immobilise or repossess the Vehicle in case of:• payment delay exceeding three (3) days;
• unlawful use;
• leaving UAE territory;
• GPS tampering;
• contractual breach;
• fraud or attempted fraud.
A reactivation fee of one thousand dirhams (AED 1,000) may apply.
17. Termination
Rafale may immediately terminate any agreement in case of:
• non-payment;
• fraud;
• misuse;
• contractual breach;
• violation of applicable laws.
The Customer must immediately return the Vehicle.
Any Vehicle not returned for more than seven (7) days may be considered abandoned.
Rafale may then:
• recover the Vehicle;
• initiate civil or criminal proceedings;
• charge recovery, towing, and storage fees.
18. Liability and Indemnity
Rafale acts as provider of vehicle rental, vehicle subscription, and Lease To Own services.
To the maximum extent permitted under UAE law, Rafale shall not be liable for indirect damages, financial losses, or loss of business suffered by the Customer.
Rafale’s total liability shall not exceed the amount paid by the Customer during the relevant month.
The Customer agrees to fully indemnify Rafale against any claims arising from:
• negligence;
• contractual breach;
• unlawful use of the Vehicle;
• damages caused to third parties.
19. Force Majeure
Rafale shall not be liable for delays or failures caused by events beyond its reasonable control, including:• natural disasters;
• government actions;
• system failures;
• conflicts;
• legal restrictions;
• banking or network interruptions.
20. Governing Law and Arbitration
These Terms shall be governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates.
Any dispute shall:

then be finally resolved by DIAC arbitration in Dubai in the English language;
Rafale reserves the right to pursue recovery or repossession actions before Dubai Courts.
21. Electronic Signature and Acceptance
Any electronic approval, digital signature, WhatsApp confirmation, email confirmation, payment, or click on “I Agree” constitutes legally binding acceptance of these Terms and Conditions.
22. Amendments
Rafale may amend these Terms at any time.
Updated versions become effective immediately upon publication on the Platform.
Continued use of Rafale’s services constitutes acceptance of the revised Terms.
