RAFALE RENT L.L.C. — TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”, or “your”) and Rafale Car Rental L.L.C., a limited liability company duly incorporated in the Emirate of Dubai, United Arab Emirates, holding Trade Licence No. 1567586, Commercial Registration No. 2736956, and Tax Registration No. 105209212700001, with its registered address at Office No. 5, I-SH-371, Dubai Industrial City, Saih Shuaib 2, Dubai, UAE (“Rafale”, “we”, “us”, or “our”).
By accessing, registering on, or using Rafale’s website or mobile application (the “Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms and by all laws and regulations of the United Arab Emirates applicable to car-rental and subscription services.
1. Definitions
Account:
The online profile the Customer creates to access Rafale’s services.
Additional Fees:
Any amounts arising from fines, tolls (Salik), damages, late payments, or violations under these Terms.
Civil Code:
Federal Law No. 5 of 1985 (UAE Civil Transactions Law).
Consumer Protection Law:
Federal Law No. 15 of 2020 and Cabinet Decision No. 66 of 2023.
Customer:
The individual who registers an Account and enters into a Subscription with Rafale.
Damage Tariff:
Rafale’s internal schedule of repair costs applicable where insurance does not cover the damage.
Emirates ID:
The United Arab Emirates national identity card required for eligibility under these Terms.
Flex Monthly Subscription orFlex Mensuel:
The month-to-month Subscription plan described in Clause 5.1.1.
Fixed Subscription:
The 12-Month Subscription and 24-Month Subscription described in Clauses 5.1.2 and 5.1.3.
Partner Supplier:
Licensed UAE car-rental companies that own and supply Vehicles through Rafale’s Platform and remain responsible for maintaining comprehensive insurance coverage in accordance with applicable UAE law.
PDPL:
Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.
PAI:
Personal Accident Insurance, being an optional insurance product that provides coverage for bodily injury, medical expenses, disability, or death of the driver or passengers. PAI is not included in the insurance provided by Partner Suppliers and is not offered by Rafale.
Platform:
Rafale’s website or mobile application through which the Customer accesses the services.
Rafale:
Rafale Car Rental L.L.C., the legal entity providing the services under these Terms.
Salik:
The Dubai road-toll system applicable to Vehicle usage.
Subscription:
A vehicle-rental arrangement offered by Rafale for the periods and plans described in Clause 5.
Subscription Price:
The monthly rental fee applicable to the Vehicle, as displayed at booking.
12-Month Subscription:
The fixed subscription plan described in Clause 5.1.2.
24-Month Subscription:
The fixed subscription plan described in Clause 5.1.3.
Vehicle:
The motor vehicle provided to the Customer for the duration of the Subscription, including accessories, documents, and keys.
2. Scope of Services
2.1 Rafale operates a digital Platform connecting Customers with Partner Suppliers. Rafale does not own or operate any vehicle.
2.2 Rafale manages subscription booking, billing, and customer support as an intermediary.
2.3 Partner Suppliers are responsible for providing insured, roadworthy vehicles and for carrying out maintenance and repairs.
2.4 All payments, renewals, and refunds are processed exclusively through Rafale.
2.5 Rafale’s Customer service operates seven (7) days a week.
3. Eligibility
You must:
a) Be at least 21 (twenty-one) years of age;
b) Hold a valid UAE driving licence issued at least 6 months prior to booking,
c) Hold an Emirates ID; and
d) Pass Rafale’s verification checks (identity, driving, and credit-risk).
Rafale may reject any application that does not meet these criteria.
4. Account Registration and Security
4.1 You must register an Account using accurate, current information.
4.2 You are responsible for all activities under your Account.
4.3 Notify Rafale immediately of any unauthorised access or suspected fraud.
4.4 Rafale may suspend or terminate accounts violating these Terms.
5. Subscription Terms
5.1 Types of Subscriptions
Rafale offers three types of subscription plans:
5.1.1 Monthly Flex Subscription (“Flex Mensuel”)
a) The Customer may cancel the subscription up to 7 days before the end of the month;
b) The Platform will send an automatic notification asking the Customer to confirm whether they wish to;
· continue with the same vehicle;
· change vehicle; or
· stop the subscription.
c) If the Customer takes no action, the subscription is automatically renewed for the following month; and
d) If the Customer cancels during an ongoing month, the Customer must pay one (1) full month of subscription fees.
5.1.2 Twelve (12) Month Fixed Subscription
a) No vehicle exchange is permitted; and
b) An early termination fee of fifty percent (50%) of the remaining value of the contract.
5.1.3 Twenty-Four (24) Month Fixed Subscription
a) No vehicle exchange is permitted; and
b) No early termination is allowed.
5.2 Renewal
5.2.1 Flex Mensuel subscriptions renew monthly unless cancelled per Clause 5.1.1.
5.2.2 Fixed subscriptions renew only for their fixed term.
5.3 Each Vehicle has its own individual Subscription Price. Prices are set per Vehicle and are not fixed by category.
5.4 Rafale may substitute an equivalent vehicle if the booked vehicle becomes unavailable.
6. Payments and Deposits
6.1 All payments are in UAE Dirhams (AED).
6.2 The Subscription Price is displayed at booking.
6.3 Payment for each month is due in advance.
6.4 Rafale collects payments as the authorised payment agent of its Partner Suppliers.
6.5 Accepted methods: Visa, Mastercard, approved cryptocurrencies or approved digital wallets.
6.6 A late-payment charge of one hundred dirhams (AED 100) per day applies to overdue amounts.
6.7 If payment remains outstanding for more than fifteen (15) business days, Rafale may initiate legal action to recover the outstanding amount.
6.8 Rafale does not require any security deposit. All fines, penalties, damages, repairs, or costs will be charged directly to the Customer’s registered payment card.
7. Customer Responsibilities and Restrictions
7.1 You must:
a) operate the vehicle lawfully and safely;
b) ensure only authorised drivers use it;
c) immediately report accidents, thefts, or defects to Rafale and to the police;
d) return the vehicle in the same condition (fair wear and tear accepted).
7.2 You must not:
a) drive outside UAE borders or on desert, sand, beach, or unpaved roads;
b) race, drift, or tow;
c) smoking in the vehicle is strictly prohibited. Cigarette smoke can reduce the value of the vehicle significantly. A financial compensation will be charged based on the persistent odour level, as determined following inspection.
d) vaping is subject to a fixed penalty of one thousand dirhams (AED 1,000).
e) pets remain prohibited.
f) use the vehicle for deliveries or hire;
g) drive under the influence of alcohol or drugs;
h) tamper with mileage or GPS devices.
7.3 Violation of these rules authorises Rafale to terminate the Subscription and repossess the vehicle immediately.
8. Maintenance and Servicing
8.1 Partner Suppliers perform scheduled maintenance at authorised service centres.
8.2 You must present the vehicle for service when notified; failure to do so may result in repair charges.
8.3 A temporary replacement vehicle may be provided subject to availability.
9. Accidents, Damage, and Theft
9.1 If an accident occurs, obtain a police report within 24 hours and inform Rafale immediately.
9.2 Repairs may be performed only at workshops authorised by Rafale or the Partner Supplier.
9.3 If no valid police report is produced, you bear full repair and downtime costs.
9.4 In case of theft, a police report must be filed within 2 working days.
10. Insurance
10.1 Vehicle Insurance
10.1.1 All Vehicles supplied through the Platform are owned and insured by licensed UAE rental agencies (“Partner Suppliers”). Vehicles are covered by comprehensive insurance under UAE law (Dubai Executive Council Decision No. 47 of 2017).
10.1.2 Rafale is not the insurer of any Vehicle and does not issue any separate insurance policy. The Customer acknowledges that the Vehicle is insured exclusively under the Partner Supplier’s insurance policy and that the use of the Vehicle is subject to all terms, conditions, limitations, and exclusions of that policy.
10.1.3 Partner Suppliers remain solely responsible for maintaining valid insurance coverage for the Vehicle, including the subscription, renewal, and compliance of such insurance in accordance with applicable UAE law. Rafale has no obligation to obtain or maintain additional insurance coverage, and duplicate insurance would provide no additional benefit to the Customer.
10.2 Accidents and Customer Responsibility
10.2.1 A valid police report is mandatory for all insurance claims. If the Customer is declared responsible for an accident by the competent authorities (including through a red police report), the Customer shall bear the full insurance excess / deductible applicable to the Vehicle, together with the repair costs charged by the Partner Supplier and the daily immobilisation fee for each day the Vehicle remains unavailable due to repair.
10.2.2 All accident-related amounts are recharged by Rafale to the Customer without margin or markup and exactly as invoiced by the Partner Supplier.
10.2.3 If no valid police report is produced, or if the Partner Supplier’s insurance is invalidated due to the Customer’s conduct, the Customer shall be fully liable for all damage to the Vehicle and all associated downtime costs.
10.3 Insurance Exclusions
10.3.1 Insurance does not cover, and the Customer remains fully liable for, any damage or loss arising from:
a) use of the Vehicle by an unauthorised driver;
b) off-road, desert, beach, sand, or unpaved-road driving;
c) intentional, reckless, or negligent conduct;
d) driving under the influence of alcohol or drugs;
e) failure to obtain a valid police report;
f) tampering with Vehicle systems, including mileage or GPS devices;
g) loss of keys or personal items; and
h) damage to tyres, wheels, or rims.
10.3.2 Damage that is excluded from insurance cover shall be charged to the Customer in accordance with Rafale’s Damage Tariff and the Partner Supplier’s applicable policies.
10.4 Personal Accident Insurance
10.4.1 The insurance provided by Partner Suppliers covers the Vehicle and third-party liability only. It does not include Personal Accident Insurance (“PAI”) or any coverage for bodily injury, medical expenses, disability, or death of the driver or passengers.
10.4.2 Rafale does not provide, arrange, or procure PAI or any form of personal bodily injury coverage.
10.4.3 The Customer is solely responsible for obtaining any personal accident or medical insurance they deem necessary.
11. Fines, Violations, and Salik
11.1 You are liable for all traffic, parking, Salik, and other government fines incurred.
11.2 Rafale may automatically settle such fines and recover the amount plus an administration fee of a hundred dirhams (AED 100) per fine.
11.3 Black-point penalties remain on the driver’s licence.
11.4 A Salik fee of AED 1.25 per toll applies in addition to RTA charges.

13. Data Protection
13.1 Rafale processes personal data in accordance with Federal Decree-Law No. 45 of 2021 (PDPL).
13.2 Data collected: identity documents, driving licence, contact details, and payment information.
13.3 Purpose: verification, billing, insurance, compliance, and customer service.
13.4 Customers may request correction or deletion of data by emailing help@rafale-rent.com .
13.5 Data is stored on secure UAE-based servers and not transferred abroad without consent.
14. Vehicle Immobilisation and Repossession
Rafale or the Partner Supplier may remotely immobilise or repossess a vehicle if:
a) payment is overdue for more than 4 days;
b) the vehicle is used unlawfully or outside UAE;
c) GPS tampering is detected. Reactivation fee: AED 1 000.
15. Cancellation and Termination
15.1 The Customer may cancel the Flex Monthly Subscription by giving 7 days’ written notice before the start of the next billing cycle, as set out in clause 5.1.1. If the Customer cancels during an ongoing month, the Customer remains liable to pay one (1) full month of the Subscription Price.
15.2 Fixed Subscriptions as set out in clause 5.1.2 and 5.1.3 of these Terms and Conditions:
a) For the 12-Month Subscription, early termination is subject to a penalty equal to 50% of the remaining value of the contract; and
b) For the 24-Month Subscription, no early termination is permitted.
15.3 Rafale may terminate the Subscription immediately in the event of non-payment, misuse of the vehicle, fraud, breach of these Terms, or violation of applicable law.
15.4 Upon termination, return the vehicle in the agreed condition; all outstanding amounts will be charged to the Customer’s registered payment card.
16. Liability and Indemnity
16.1 Rafale acts solely as intermediary between you and the Partner Supplier.
16.2 To the maximum extent permitted under Civil Code Arts. 282 and 296, Rafale is not liable for indirect or consequential losses.
16.3 Total Rafale liability shall not exceed the Subscription Price paid for the relevant month.
16.4 You agree to indemnify Rafale, its directors, and employees against all claims arising from your negligence, breach, or unlawful use of the vehicle.
17. Force Majeure
Rafale shall not be liable for delay or failure caused by events beyond its control, including natural disasters, government orders, or system outages, per Civil Code Art. 273.
18. Governing Law and Dispute Resolution
18.1 These Terms are governed by the laws of the Emirate of Dubai and the Federal laws of the UAE.
18.2 Disputes shall first be referred to Rafale Customer Service for amicable settlement.
18.3 Failing resolution within 15 days, disputes shall be finally settled by arbitration under the Dubai International Arbitration Centre (DIAC) Rules by a sole arbitrator in English, seated in Dubai.
18.4 Rafale may alternatively pursue payment or repossession actions before the Dubai Courts.
18.5 Customers may raise complaints by email to help@rafale-rent.com within 14 days of the event. Rafale shall acknowledge receipt within 3 business days and respond within 14 business days. If unresolved, the matter shall proceed in accordance with Clause 18.3.
19. Amendments
Rafale may amend these Terms at any time; updates take effect upon publication on the Platform. Continued use constitutes acceptance of the revised Terms.
